Friday stock taking

It’s Friday, so let’s take a look at how effectively the Trump Administration has dealt with world and domestic events this week while it obsesses over impeachment:

  • The North Koreans continue to launch increasingly capable ballistic missiles.
  • While suffering from reimposed sanctions, Iran is defying the US and increasing uranium enrichment beyond the limits specified the nuclear deal the US withdrew from.
  • The Iranian attack on Saudi Arabia’s oil production facilities has elicited no visible response from the US or Saudi Arabia, which is joining the United Arab Emirates in playing footsie with Iran.
  • While failing to remove from Syria all the troops Trump said would be withdrawn, the US has allowed Turkey to take over a buffer zone along its border with Syria, leading to large-scale displacement of people there. Russia has also gained a foothold in northeastern Syria, as has the Assad regime.
  • The trade war with China drags on, with the US trade deficit ballooning and Asian partners and allies doubting US commitments in the region.
  • Venezuelan autocrat Maduro has survived despite American pressure, as has the Communist regime in Cuba and Evo Morales’ rule in Bolivia.
  • In Europe, French President Macron is describing NATO as “brain dead” because of Trump’s lack of commitment to it and Trump’s pal UK Prime Minister Johnson is being forced into an election to try to confirm his Brexit plan, which Trump has supported.
  • In the Balkans, the Administration has confused everyone with the appointment of two special envoys whose relationship to each other and to US policy is opaque.
  • That’s all without even mentioning Ukraine, where State Department officials have confirmed that President Trump tried to extort an investigation of his political rivals from newly elected President Zelensky in exchange for Congressionally approved military aid.

The home front is even worse:

  • A New York State Court has forced Trump into a $2 million settlement in which he has admitted improper and fraudulent use of his family foundation.
  • Republicans lost the governorship in Kentucky and control of both houses of the Virginia assembly in off-year elections earlier this week. Congressional Republicans are nervous.
  • President Trump’s personal lawyer affirmed that everything he did in Ukraine was to serve his client’s personal interests, a statement that confirms public assets were used for private purposes.
  • The Attorney General, a stalwart defender of his boss, has declined to make a public statement supporting Trump’s claim that he did nothing wrong in his infamous phone call with President Zelensky.
  • The House Democrats are piling up subpoenas that the White House is ignoring, heightening the likelihood that obstruction of Congressional oversight will be added to the impeachment charges and limiting the news to the sharp critiques of non-White House officials.
  • The economy is slowing, especially in some “swing” districts vital to Trump’s hopes for a win in the electoral college in 2020, when he is sure to lose the popular vote once again, likely by a wider margin than in 2016.

I suppose it could get worse, and likely will. But it has been a long time since we’ve seen an American Administration in worse shape than this.

Daring to dream

This joint “non-paper” from the presidents of the Serbia and Kosovo Chambers of Commerce arrived in my inbox earlier this week. My compliments to them for the constructive tone and interesting ideas. Economic progress is not a substitute for a political settlement, but it might make one easier to achieve:

NON PAPER

  • We, as the Presidents of the Serbian and Kosovo Chambers of Commerce, are recollecting the commitments of all the parties to the goals expressed in the Final Declaration of the Conference on the Western Balkans held in Berlin, 2014;
  • We regret the disunity of the European Union that leads to the refusal to open membership talks with North Macedonia and Albania despite the clear endorsement and promise made to those two countries by the European Council and the Commission. Moreover, the Eurochambers, the biggest  association of businesses in Europe representing more than 21 million businesses, strongly supported the European Union enlargement on the Western Balkans as it will benefit both sides economically and will foster stability in the region;
  • As the main advocates of the free trade and regional economic integration, we are calling for the adoption of a “New Deal for the Region“ that should lead to a creation of the Western Balkans Economic Area, based on well-established principles of other similar models, including the European Economic Area, built on four fundamental freedoms of the European Union – the free movement of people, goods, services and capital among its members, enabling  economic growth, attracting foreign investments and enhancing the global competitiveness of the region. Thus, we are appealing to the European Union to lift the visa regime with Kosovo, enabling its citizens to join their neighbours in enjoying the unrestricted freedom of movement;
  • We are aware that the process of normalizing relations between Serbia and Kosovo is one of the key prerequisites for providing a prosperous and stable future to all citizens in the region, and will have a positive effect for overall economic, social and political development of the Western Balkans;
  • Finding a long-lasting, sustainable and comprehensive agreement that would provide the future stability of Serbian and Kosovar societies, and laying the ground for unleashing their development potential must be priority for the Kosovo and Serbian Governments, European Union and all other interested parties willing to contribute to the stabilization and development of Serbia, Kosovo and the Western Balkans as a whole;
  • To guarantee the success of the agreement, all parties need to be committed and to secure its implementation through a carefully-designed action plan of its implementation, with an overall investment and development package;
  • Financial and overall support of the process of normalization, development and cooperation of Kosovo and Serbia should be a priority for international financial institutions, bilateral donors, the European Union, its member states, the United States and for the Serbian and Kosovo Governments;
  • Our two Chambers are committed to contribute, in every possible way, to finding a comprehensive and long-lasting agreement between Kosovo and Serbia by proposing priorities in the form of a document on economic cooperation between Kosovo and Serbia, which will take into consideration all the obligations of the two sides, but will also propose areas of  cooperation – in energy, infrastructure, education, agro industry, services and other areas – that will be the pillars and drivers of the future development;
  • We would like to reiterate our commitment to maintain excellent relations between our Chambers, with the business communities and individuals both in Serbia and in Kosovo, despite the current strained political relations between the two sides. Bearing this in mind, we are committed to further strengthening and enhancing our collaboration and dialogue in order to create a favourable environment for economic cooperation, enabling, inter alia:
    • Free movement of people, goods, services and capital, 
    • Recognition and harmonization of all pending documents,
    • Facilitation, if necessary, of talks that would lead to re-establishing and advancing road, railway, air and postal traffic connections and infrastructure,
    • Creation of positive climate and conditions conducive to joint investments in Serbia and Kosovo,
    • Contribution to resolving all other pending issues that could hamper economic development.
    • Further improving sectorial cooperation and understanding between representatives of both business communities, as well as performing matchmaking activities.
  • As the representatives of the business communities, we are calling for long-term oriented approach on putting economic and development interests ahead and working to achieve long-lasting and comprehensive agreement that would unleash and harness the creative, economic, natural, and scientific potential of Serbia, Kosovo and the region as a whole;
  • We deeply believe that having a lasting solution will make our economies stable and more attractive for foreign investments, especially for those coming from Germany and other EU countries, providing them with a bigger market, skillful workforce able to compete with the latest technological and IT challenges and strategic geographic position;
  • Finally, we are committed to provide support to any businesses, institutions and individuals who share our dream of making the Western Balkans developed, prosperous and fully integrated into the European Union.

Albania needs to double down

I delivered these remarks this morning at a Mediterranean University of Albania conference on “US policy in the Western Balkans” in Tirana:

It is a great pleasure to be back in Tirana. My thanks to the Mediterranean University of Albania for inviting me and making it possible.

I think it has been at least 10 years since I was here last. I only needed to drive around a bit yesterday afternoon to see how dramatically Tirana has changed since then, never mind since my first visit here in 1997 to observe an election held in the midst of gunfire.

But let me get to Albania later. First I would like to discuss the world as seen by an American, then the Balkans region, and lastly Albania in the regional and global contexts.

The world today is a disordered one. The unipolar moment that enabled so much of what the United States did to bring order to the Balkans in the 1990s ended with the attack on the World Trade Center in 2001.

There ensued a war on terror that initially enlisted much of the world in response: NATO triggered Article 5 and supported the US invasion of Afghanistan, but unanimity was quickly lost with the invasion of Iraq and the Sunni insurgency there, led by Al Qaeda and Ba’athist diehards.

The 2008 financial crisis further frayed international consensus: European growth has still not recovered while China’s rise accelerated, and high oil and gas prices gave Russia opportunities to revive its military and reassert its great power status, which it has done with interventions in Ukraine and Syria.

The Greek financial crisis, Brexit, immigration, and the rise of the populist ethno-nationalist right within the EU and in the US have changed the basic parameters of our geopolitics.

Today we live in a world in which the liberal democratic consensus, based on free markets and the conviction that everyone is entitled to equal rights and opportunities, has frayed.

Russia, China, Turkey, and others are offering an alternative autocratic bargain: in exchange for unfettered long-term power, their leaders are offering state-sponsored economic growth and political stability, at least to those who identify with the majority ethnic group.

How does all this impact the Balkans?

First and foremost slow economic growth in Europe depresses the Balkan economies; the region can only thrive when the EU does.

Europessimism correlates closely with the business cycle. Only with a revival of growth will Europe show renewed interest in enlargement, which will provide the young labor Europe lacks and needs.

Second: Moscow’s trouble making, while not so evident in Albania, is plaguing Macedonia, Serbia, Montenegro, and Bosnia. Your neighbors are facing concerted efforts to slow or block NATO and EU accession. Even Montenegro and North Macedonia are still targeted.

Moscow has re-introduced into the Balkans assassination, state disinformation and propaganda, and rent-a-riot techniques we all hoped had disappeared with the Soviet Union.

Third: China, during the Cold War Enver Hoxha’s only friend in the world, is offering financing for much-needed infrastructure.

Unlike many Westerners, I see lots of potential benefit in Beijing’s Belt and Road projects, but caveat emptor: China isn’t giving aid, it is financing projects it regards as beneficial to China on terms that can be onerous if the expected returns fail to materialize.

Fourth: Turkey, as a former colonial power in much of the Balkans and a near neighbor, naturally plays an important role in the region. But President Erdogan has taken a turn in the autocratic and Islamist direction.

His example is no longer as positive as once it was, and his efforts to get Balkan countries to capture and render his enemies are undermining rule of law in young Balkan democracies.

Let me turn now to put the focus on the Balkans themselves.

My view is that there are only two remaining war and peace issues in the region.

One is normalization of relations between Kosovo and Serbia.

The other is fixing the dysfunctional government we gave Bosnia and Herzegovina in the Dayton peace agreements.

Before anything can happen on normalization, Pristina needs a new government. I imagine that means the LDK and Vetevendosje will share power in a post-electoral coalition, perhaps supported by some lesser parties, including some representing minorities.

As far apart as the LDK and VV are on some issues and in electoral constituencies, they both grew out of the nonviolent protest movement in Kosovo and will be replacing a KLA coalition whose partners grew out of the violent rebellion.

I hope that betokens a renewed commitment to Kosovo statehood, sovereignty, and territorial integrity, as well as a broader coalition for the dialogue with Belgrade, along the lines of the platform that the last parliament prepared but the constitutional court ruled was the responsibility of the government.

The Europeans and Americans will be pressing Pristina hard for an agreement with Belgrade in advance of Serbia’s April 2020 election. I see no advantage to Kosovo in giving in to this pressure.

Pristina will need to be ready to walk away from a bad deal in order to get a good one. A bad deal is one that in any way breaches the country’s sovereignty and territorial integrity; a good one will allow for ample decentralization and self-governance for minority communities.

Some of you will no doubt ask, but what does the appointment of two US envoys betoken about US policy on normalization?

The short answer is that I don’t know. I think it reflects more confusion than intention. But I won’t be surprised if the ethnic nationalist Ambassador Grenell, who has done his best to offend the German government, tries to revive the land swap idea that failed so miserably the last time around.

Let me be clear: the permanence of borders—and specifically the refusal to move internal boundaries to accommodate ethnic differences when changing them to international borders—is fundamental to peace and security in the region, since it was established by the Badinter Commission in the early 1990s.

As for Bosnia and Herzegovina, I fear it will need to wait. The international community is simply incapable of dealing with two big issues at once.

Milorad Dodik will continue to fulminate about independence, some Croats will continue to dream of a third entity, and the Bosniaks will try to ignore both and defend the country’s sovereignty and territorial integrity.

But until there is a concerted effort that gains the support of all three constituent peoples to enable the Sarajevo central government to negotiate and implement the acquis communautaire, I fear little will change.

Let me turn now to Albania.

This country has made fantastic progress: you are now a member of NATO and a candidate for EU accession.

Let’s remember: when I first came here just 22 years ago, the country was in chaos, in the aftermath of the collapse of the pyramid schemes.

Since then you’ve seen good if not spectacular economic growth, the construction of a post-Communist state and a market economy, and integration with the other Balkan countries as well as with the rest of Europe.

You have met the criteria for opening of EU accession negotiations. It is only internal political circumstances in two other European countries that have prevented it from happening.

France and the Netherlands should be ashamed of what they’ve done to both North Macedonia and Albania.

But they are not, because both are democratic countries with leaders responding to pressures from their own national constituencies. Albanians and Macedonians don’t get to vote in Paris or The Hague.

The question now is how to respond to this clearly unjustified and reprehensible delay in acknowledging achievements that both Skopje and Tirana are rightly proud of.

You are of course disappointed and angry. I share those sentiments. But they won’t get you far.

The right response I am afraid is renewed commitment to the reforms required for EU membership. NATO membership for Macedonia points in the right direction.

Delayed opening of negotiations should not delay implementation of the acquis. Most of the benefits of EU membership come well before accession, from the reforms you undertake.

Tirana has made remarkable progress getting to the verge of opening negotiations, but it can make still more during the current delay, however long it lasts.

Take a hint from the Montenegrins: they never stopped preparing for NATO membership, even when people in Washington thought it unlikely. They likewise press on with adopting the acquis, knowing full well that the French and Dutch may be no more favorable to Montenegro’s accession than they have been to opening negotiations with North Macedonia and Albania.

I’m reminded of Zeno’s paradox: if you halve the distance between any two people every second, they should never touch mathematically. But they do in practice.

Make Albania an EU-compliant country in every aspect of the acquis, which will take a decade or more, and one day politics in France and the Netherlands will allow accession to happen.

There are, it seems to me, two areas that require priority attention in Albania: one is rule of law; the other is political behavior.

You are tired I know of the Americans and Europeans who preach rule of law. So am I. But you need it, not for EU membership but for yourselves.

Your institutions are much better than once they were, but you still lack a “culture of lawfulness.” It is not easy to create, and I would readily admit that parts of the United States seem to me to lack it.

But that is what you need to ensure that the law doesn’t need to be enforced as much as it prevails because that is what citizens want.

I know it is difficult to accept, but in liberal democracies rights, privileges, and responsibilities adhere to the individual, not to families, clans, ethnic groups, or even political parties.

The day will come here, as it has in Chicago, when getting a job for your unqualified cousin is not a family obligation but a corrupt abuse of power.

The day will also come when you will not tolerate politicians who have sources of wealth they are unable to account for. Some of your judges have already been dismissed on these grounds.

Universities like this one are vital for the preparation of a new cadre of qualified individuals who will not rely on connections but on talents and merit for their careers and income.

Those qualified individuals will also moderate political behavior, which along with rule of law is particularly important in this highly conflictual country.

In real democracies, there is always the possibility of alternation in power. Serving in the opposition is frustrating but just as important to the system as serving in the majority.

Some of you will of course see the remarks I am about to make as suggesting that I am taking sides. That is not my intention.

I aim instead trying to convince you that participation is an obligation, even if you think the system is unfair.

But somehow in the Balkans people think they will gain more by boycotting than participating.

Sure there are political processes I might want to boycott, but the normal behavior should be participation.

Liberal democracies depend on separation of powers and institutional limits on executive power. Political participation and insistence on professionalization of government functions can help make that a reality.

People who don’t vote, parties that don’t run in elections, or don’t occupy the seats or jobs they have won are not doing their best to fulfill the responsibility to represent their constituencies.

Nor can a country hope to assume its proper role internationally if it is unable to be inclusive domestically.

A word about foreign policy. Every now and then, the Albanian question arises: will Albanians live in six different Balkan countries, or will they challenge the existing territorial arrangements?

Nothing could harm Albania’s ambitions to join Europe more than unsettling borders or enunciating irredentist ambitions, as politicians are sometimes tempted to do.

Washington and Brussels will remain unequivocal in rejecting Greater Albania, which would lead to catastrophic population movements and widespread instability.

The wise course for Albania and Kosovo is to cure their internal ills within their current borders, maintain good relations with all their neighbors, and enjoy close cultural ties with Albanians who live in other countries.

In the end, there is no Plan B. Democracy and free markets, unencumbered by corruption and regulated by law, are the best way to ensure fair competition and rational decisions by individuals, companies, and politicians.

Nothing the Dutch or French do can prevent you from creating that kind of Albania. You are free to choose: I hope you will do so wisely.

Croatia in context

I spoke this afternoon at a National Federation of Croatian Americans session on “Croatia’s Role in Southeastern Europe–Facing Instability in the Region.” Time was shorter than anticipated, so I started at 16. My assignment was to talk about the main issues beyond Croatia in the Balkans, but I got to the Bosnian Croats and Croatia at the end.

  29. As for Bosnia and Herzegovina, I fear it will need to wait. The international community is simply incapable of dealing with two big issues at once.

  34. Beyond that, Croatia can play a crucial role as an EU and NATO member state in keeping hope alive. I trust it will do that.

Getting ready is the best revenge

Artiana Matoshi of Radio Television Kosovo asked questions. I replied:

Q: The western Balkan states can’t be included in the European Union and this was proved with not opening the negotiations for Albania and North Macedonia. How you assess the refusal of these two countries by EU?

A: This is not a refusal, it is an unexpected and unwelcome postponement caused mainly by French and Dutch internal politics.

Q: Is this injustice towards western Balkans?

A: EU members are entitled to their own decisions on enlargement, but of course they affect the situation in the Balkans. Certainly the decision was unfair after Tirana and Skopje made herculean efforts to meet all the criteria. But those efforts are not wasted: the reforms they have adopted are already benefiting North Macedonia and Albania. 

Q: How much will Kosovo be damaged by this [denial of] access of EU towards Balkans?

A: Kosovo is still waiting for the visa waiver, which has also been unfairly denied, but accession talks are still far off. The important thing to remember is that the reforms are vital, even if European promises are not fulfilled. Delay should not be seen as definitive rejection.

Q: Which is the best way for the Balkans to be included faster in EU and what happens if this cannot happen?

A: The only route I know is to qualify as quickly as possible and then wait for the political stars to align. Paris and The Hague have been very short-sighted, but in any case Albania and North Macedonia still have a lot of work to do to qualify for EU membership. Best to get on with that work and demonstrate unequivocally that they are qualified for accession, thus shortening the negotiation process.

Failure of the EU to enlarge will cause serious problems in the Balkans and benefit Russia. But that can only happen if people in the Balkans lose focus and hope. There is no better place for Tirana or Skopje than in Europe.

Murder most foul

The House yesterday passed concurrent resolution 32. Here it is:

Expressing the sense of Congress regarding the execution-style murders of United States citizens Ylli, Agron, and Mehmet Bytyqi in the Republic of Serbia in July 1999.

Whereas brothers Ylli, Agron, and Mehmet Bytyqi were citizens of the United States, born in Chicago, Illinois, to ethnic Albanian parents from what is today the Republic of Kosovo, and who subsequently lived in Hampton Bays, New York;

Whereas the three Bytyqi brothers responded to the brutality of the conflict associated with Kosovo’s separation from the Republic of Serbia and the Federal Republic of Yugoslavia of which Serbia was a constituent republic by joining the so-called Atlantic Brigade of the Kosovo Liberation Army in April 1999;

Whereas a Military-Technical Agreement between the Government of Yugoslavia and the North Atlantic Council came into effect on June 10, 1999, leading to a cessation of hostilities;

Whereas the Bytyqi brothers were arrested on June 23, 1999, by Serbian police within the Federal Republic of Yugoslavia when the brothers accidently crossed what was then an unmarked administrative border while escorting an ethnic Romani family who had been neighbors to safety outside Kosovo;

Whereas the Bytyqi brothers were jailed for 15 days for illegal entry into the Federal Republic of Yugoslavia in Prokuplje, Serbia, until a judge ordered their release on July 8, 1999;

Whereas instead of being released, the Bytyqi brothers were taken by a special operations unit of the Serbian Ministry of Internal Affairs to a training facility near Petrovo Selo, Serbia, where all three were executed;

Whereas at the time of their murders, Ylli was 25, Agron was 23, and Mehmet was 21 years of age;

Whereas Yugoslav President Slobodan Milosevic was removed from office on October 5, 2000, following massive demonstrations protesting his refusal to acknowledge and accept election results the month before;

Whereas in the following years, the political leadership of Serbia has worked to strengthen democratic institutions, to develop stronger adherence to the rule of law, and to ensure respect for human rights and fundamental freedoms, including as the Federal Republic of Yugoslavia evolved into a State Union of Serbia and Montenegro in February 2003, which itself dissolved when both republics proclaimed their respective independence in June 2006;

Whereas the United States Embassy in Belgrade, Serbia, was informed on July 17, 2001, that the bodies of Ylli, Agron, and Mehmet Bytyqi were found with their hands bound and gunshot wounds to the back of their heads, buried atop an earlier mass grave of approximately 70 bodies of murdered civilians from Kosovo;

Whereas Serbian authorities subsequently investigated but never charged those individuals who were part of the Ministry of Internal Affairs chain of command related to this crime, including former Minister of Internal Affairs Vlajko Stojilkovic, Assistant Minister and Chief of the Public Security Department Vlastimir Djordjevic, and special operations training camp commander Goran Guri Radosavljevic;

Whereas Vlajko Stojilkovic died of a self-inflicted gunshot wound in April 2002 prior to being transferred to the custody of the International Criminal Tribunal for the former Yugoslavia where he had been charged with crimes against humanity and violations of the laws or customs of war during the Kosovo conflict;

Whereas Vlastimir Djordjevic was arrested and transferred to the custody of the International Criminal Tribunal for the former Yugoslavia in June 2007, and sentenced in February 2011 to 27 years imprisonment (later reduced to 18 years) for crimes against humanity and violations of the laws or customs of war committed during the Kosovo conflict;

Whereas Goran Guri Radosavljevic is reported to reside in Serbia, working as director of a security consulting firm in Belgrade, and is a prominent member of the governing political party;

Whereas the Secretary of State designated Goran Radosavljevic of Serbia under section 7031(c) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2018 as ineligible for entry into the United States due to his involvement in gross violations of human rights;

Whereas two Serbian Ministry of Internal Affairs officers, Sretan Popovic and Milos Stojanovic, were charged in 2006 for crimes associated with their involvement in the detention and transport of the Bytyqi brothers from Prokuplje to Petrovo Selo, but acquitted in May 2012 with an appeals court confirming the verdict in March 2013;

Whereas the Serbian President Aleksandar Vucic promised several high ranking United States officials to deliver justice in the cases of the deaths of Ylli, Agron, and Mehmet Bytyqi;

Whereas no individual has ever been found guilty for the murders of Ylli, Agron, and Mehmet Bytyqi or of any other crimes associated with their deaths; and

Whereas no individual is currently facing criminal charges regarding the murder of the Bytyqi brothers despite many promises by Serbian officials to resolve the case: Now, therefore, be it

That it is the sense of Congress that—

(1) those individuals responsible for the murders in July 1999 of United States citizens Ylli, Agron, and Mehmet Bytyqi in Serbia should be brought to justice;

(2) it is reprehensible that no individual has ever been found guilty for executing the Bytyqi brothers, or of any other crimes associated with their deaths, and that no individual is even facing charges for these horrible crimes;

(3) the Government of Serbia and its relevant ministries and offices, including the Serbian War Crimes Prosecutor’s Office, should make it a priority to investigate and prosecute as soon as possible those current or former officials believed to be responsible for their deaths, directly or indirectly;

(4) the United States should devote sufficient resources fully to assist and properly to monitor efforts by the Government of Serbia and its relevant ministries and offices to investigate and prosecute as soon as possible those individuals believed to be responsible for their deaths, directly or indirectly; and

(5) progress in resolving this case, or the lack thereof, should remain a significant factor determining the further development of relations between the United States and the Republic of Serbia.
