Bully is as bully does
Chuck Sudetic is at it again: he published the original allegations of murder and organ trafficking by Kosovar leaders with Carla Del Ponte in her memoir. He reiterated the allegations in the Washington Post in 2011, neglecting to mention the lack of forensic evidence dutifully noted in the Council of Europe report on which he relied heavily. Now he has gotten lots of former diplomats to make anonymous allegations against Kosovar “bullies,” though many of their allegations appear to be about corruption rather than murder and organ trafficking. It is about time someone worried who the bully really is.
Let me be clear: I have no idea whether there are Kosovar leaders guilty of the crimes alleged. I certainly won’t be surprised if some of them are corrupt. But I don’t even know if the alleged organ-trafficking and murder occurred.
I have been hearing the allegations since the early 2000s, when the journalist who discovered the story recounted it to me. He never published it because he thought he had insufficient evidence to meet journalistic standards, but he turned over what evidence he had to the EU rule of law authorities in Kosovo. They were unable to make a case and turned over what they had to ICTY, which allegedly lost whatever it was given, ironically during Carla Del Ponte’s time as chief prosecutor.
The Council of Europe and Dick Marty chimed in in 2010, with a report full of dramatic allegations but no forensic evidence and a sentence, never mentioned by Chuck, saying that no pronouncements of guilt are justified. Let me cite the precise language (para 175):
Our task was not to conduct an criminal investigation – we are not empowered to do so, and above all we lack the necessary resources – let alone to pronounce judgments of guilt or innocence.
The contradiction is not my invention; it is in the original document.
Now we’ve got Chuck piping up again with a piece in which he admits Hashim Thaci spoke forcefully and publicly in the Kosovo parliament in favor of a special tribunal to examine the allegations, but instead of praising him for his courage and wondering if he might in fact be innocent Chuck smears as much mud as he can, using anonymously sourced statements from present and former diplomats.
Hmmm. I’m a former diplomat and pleased to be quoted by name whenever I am pretty sure I’m correct.
Is Hashim capable of saying one thing publicly while maneuvering to do another behind the Americans’ and Europeans’ backs? Any Balkans politician worth his salt can do that, but I’d like to see better evidence of it than Chuck puts forward.
I’m on record in favor of the special court that the Americans and Europeans are pushing on Kosovo to receive indictments and try cases arising from the allegations against Kosovo leaders. The Kosovo court system has not been prepared or willing to take on these cases. The juridical difficulties and likelihood of initimidation in tiny Kosovo justify a court that sits outside the country staffed by internationals. But the kind of bullying Chuck is doing is hardly conducive to getting the politicians of a newly independent (and not yet fully sovereign) country to swallow this bitter pill.
Accountability is important. So is responsibility. Serious allegations based on anonymous sources without corroborating evidence is irresponsible.

Discussion will then turn to highlighting the cases of those activists, including members of the Saudi Civil and Political Rights Association (ACPRA) and human rights lawyer Waleed Abu al-Khair, who have sacrificed their independence to raise awareness of human rights abuses and bring reforms to this system. On Knife’s Edge: The International Criminal Tribunal for the former Yugoslavia’s Impact on Violence Against Civilians | Wednesday, July 23rd | 12:00-1:00 | Wilson Center | REGISTER TO ATTEND | The post-Cold War era has witnessed horrific violence against non-combatants. In the Bosnian War alone, tens of thousands of civilians died. The founders of the International Criminal Tribunal for the former Yugoslavia (ICTY)—and then of the permanent International Criminal Court (ICC)—hoped these courts might curb such atrocities. However, we still know very little about their actual impact. This talk will draw on the ICTY’s experience as the first wartime international criminal tribunal to provide insight into how and when these institutions might affect violence against civilians. The path of civil resistance
Thursday the United States Institute of Peace held a talk on “Civil Resistance and Peacebuilding: How They Connect.” The panelists included Maria Stephan, USIP Senior Policy Fellow, Manal Omar, Acting Vice President for USIP’s Center for Middle East and Africa and Kerri Kennedy, Associate General Secretary for International Programs at American Friends Service Committee. The event was moderated by Nancy Lindborg, President of USIP.
Stephan introduced the concept of non-violent civil resistance by comparing it to traditional peacebuilding. The former intensifies conflict in an attempt to shift power so as to get to a point of meaningful negotiation. Civil resistance ripens conflicts for conflict resolution. The latter mitigates and deescalates conflicts using techniques such as dialogue, mediation and problem-solving. Both approaches are different but fall under means of conflict transformation.
Stephan also produced empirical data on the efficacy of non-violent resistance compared to armed struggles. She looked at 323 campaigns in 1900-2006 in which at least 1000 people were involved in fighting against dictatorships and for territorial self-determination. She held constant any thing that would determine the conflict’s outcome, such as GDP, military might of the opponent or regime and socioeconomic divisions in society. The results showed that non-violent resistance campaigns outperformed their armed competitors by 2:1.
Additionally Stephan’s empirical research showed society is better off after the struggle if non-violent methods are employed. Non-violent campaigns are strongly correlated with democratic consolidation. The probability a country will be a democracy five years after a campaigns ends is 57% among non-violent movements against less than 6% among successful violence campaigns. Also, the likelihood of recurrence to civil war for violent campaigns is almost double that for non-violent campaigns.
Kennedy spoke about the relationship between civil resistance, peacemaking and peacebuilding. Although there may be tension among the three elements, Kennedy believes a strategy works best when all the elements are incorporated. She added that often peacebuilding and civil resistance are happening at the same time, as opposed to sequentially. For example, in Egypt it wasn’t just a quick social movement that lead to the fall of Mubarak’s regime—decades of effort led to the large social movement. Kennedy also advocated dialogue first to bring about a solution, but warned that it’s rare for dialogue to work on its own without the pressure of mobilization.
Omar elaborated on the challenges of civil resistance as a form of conflict transformation. One issue is redirecting people’s anger towards productive efforts. A person who uses his or her anger to call for social justice is a good thing, but it’s difficult to prevent that anger from morphing into violence. Similarly, defectors from the security apparatus don’t want to put their arms down when they join non-violent resistance movement, which leads to the lines blurring between violence and non-violence. Omar called for the international community to provide people more alternatives, so they don’t turn to violence. Too many people have been disillusioned with the failure of the “ballot box over bullet,” but lack peaceful, constructive options for conflict transformation.
Omar also commented on the importance of transitional justice in post-conflict situations. Many countries in transition begin state building without ensuring accountability, which prompts these countries to slide back into civil wars. Sometimes the international community pushes transitional states towards creating a constitution, holding elections and essentially meeting indicators of success without addressing transitional justice. The consequence is the loss of support from people who were dedicated to the non-violent cause from the beginning because they don’t see justice served.
All three panelists emphasized that the civil resistance path is long and obscure at times. Kennedy claimed the importance of small community steps should not be dismissed. It is necessary to debunk the myth that violent intervention is fast and effective, when it’s actually very messy. Omar added that the regime changes in Egypt and Tunisia were the result of years of mobilizing, organizing groups, training, making mistakes and learning from them. They weren’t merely 25-day struggles. Stephan said that civil resistance encompasses more than protests, demonstrations and boycotts, it also involves social audits, community monitoring and creating parallel structures and institutions, which can empower the nation-building process.
Tunisia needs more help
On Tuesday, the House of Representatives Subcommittee on the Middle East and North Africa hosted a hearing on Tunisia’s Fragile Democratic Transition. Opening statements were given by Ileana Ros-Lehtinen, Chairman of the subcommittee, Theodore Deutch, Ranking Member of the subcommittee, and Steve Chabot, member of the committee. Testimony was provided by Ambassador Mark Green, President of IRI, Leslie Campbell, Senior Associate and Regional Director at NDI, Aaron Zelin, Richard Borow Fellow, WINEP, and William Sweeney President and CEO, IFES.
Ros-Lehtinen stated that Tunisia is the only country that has made positive gains after the Arab Spring, but these gains are uncertain. Despite its new constitution and elections, Tunisia has been the victim of two recent high-profile terror attacks. The attacks remind us that tourism accounts for 15% of Tunisia’s GDP. Even before the Sousse attack, economic problems in Europe were hurting Tunisia’s tourism.
President Essebsi has claimed that another attack would cause the collapse of Tunisia’s government. The stability of Tunisia and its democratic transition is in the US’s interest. The designation of Tunisia as a major non-NATO ally last week was an important step. But Tunisia is home to the largest contingent of foreign fighters in Iraq and Syria, and returnees from these conflicts pose a threat. The US needs to help Tunisia strengthen its institutions and invest in its future.
Deutch hailed the peaceful transfer of power after Tunisia’s 2014 parliamentary elections and the ability of its parties to form coalitions. However, Tunisia’s economy has struggled since the revolution. Unemployment is at 15%, and among working-class youth is nearly triple that figure. Tourism has struggled especially after recent attacks. There are home-grown terror cells, external threats from Libya and Algeria, and the threat of returnees from Iraq and Syria. Tunisia’s government must not sacrifice freedom in the name of security. He praised the designation of Tunisia as a major non-NATO ally, as well as the MOU signed in May.
Chabot echoed the statements of Ros-Lehtinen and Deutch concerning Tunisia’s potential to serve as a model and the terror threat. He also expressed concern that Monday’s disappearance of 33 Tunisian citizens on the border with Libya indicates radicalization in that area.
Ambassador Green also affirmed that Tunisia is the brightest hope for democracy in the Middle East and North Africa. The 2014 elections showed that Tunisia’s stakeholders are committed to democracy in a polarized, unstable region. The US administration must train and help reform Tunisia’s security services, which are a holdover from the Ben-Ali regime.
Unemployment weighs most heavily on young Tunisians. Since 2014, IRI has supported decentralization. Tunisia’s bureaucracy stifles entrepreneurship and foreign investment. Tunisia’s government cannot put off economic reform despite pressing security concerns.
Low youth voter participation is another major concern. Civil society groups are necessary to involve youth and connect them to the democratic transition. The US needs to focus more of its aid on supporting democratic governance. Tunisia will likely hold elections in 2016, so the time to foster genuine democratic competition is now.
Campbell several factors that differentiate Tunisia from other Arab countries:
- Tunisia took time to develop its constitution rather than rush to snap elections.
- The military stayed out of politics.
- Civil society was allowed to flourish.
- Tunisia’s political establishment avoided polarizing rhetoric and sought compromise.
Tunisia’s Islamists defied expectations and peacefully transferred power. The situation in Egypt, international pressure, and popular pressure made them respect the democratic process. NDI helped create space for political debate and the parties’ investments in their internal structures have strengthened the democratic process. Campbell cited the balance between freedom and security as a major challenge.
Tunisia does not appear as corrupt as some other countries but there is crony capitalism controlled by privileged families. If you’re not from the right family or region, there is no way to get ahead. It is important to foster a meritocracy. Business leaders want access to capital and want to join international organizations, but there is a sense that crony capitalists are circling the wagons under the current government.
Zelin stated that there have been 11 known attacks by Al Qaeda in the Islamic Maghreb (AQIM) and ISIS since the last election, as well as 10 counter-insurgency operations by the Tunisian military. The US has provided a lot of assistance. Tunisia’s jihadi problem has been present for approximately 20 years, but is coming to the surface now because many exiled radicals returned to Tunisia in 2011.
From 2003-2011, many individuals falsely accused of being terrorists were imprisoned, only to be radicalized in prison. If Tunisia’s current security bill is passed, we could see a repeat of this. The Ministry of Interior is corrupt and many of the bad practices of the Ben-Ali regime are returning, including possible torture in prisons and arbitrary arrests. These are possible sources of radicalization. The police require retraining and capacity building so they can be seen as protectors, not a group that takes away rights.
The government has had difficulty transparently investigating terrorist attacks and communicating the results to the people. President Essebsi’s comment that the government would collapse following another attack was irresponsible and amateurish.
Tunisia has reinforced its border with Libya and is considering a border fence. However, there are individuals with weapons already inside Tunisia and others who come from Algeria.
Sweeny stated that only 16% of American aid to Tunisia goes toward strengthening democracy. More can be done. Prior to the 2016 elections several things are necessary:
- A standard legal framework for local elections.
- Greater professionalism from the electoral commission and capacity-building in its regional offices.
- Implementation of lessons learned from 2014.
- Focus on unemployed youth, for whom dictatorship and democracy remain much the same.
Sweeny agreed with Campbell’s observations about crony capitalism, and stated that it will hinder foreign investment. Foreign investment will also be constrained by a lack of confidence in Tunisia’s stability.

Why Human Rights Matter in Policy toward North Korea | Monday, July 13th | 12:00-2:00 | National Endowment for Democracy | REGISTER TO ATTEND | The 2014 report of the UN Commission of Inquiry (COI) on human rights in North Korea successfully brought international attention to the severity of the Kim regime’s human rights violations and the plight of the North Korean people, and highlighted the need for the international community to do more to address human rights in the isolated country. At the same time, the impact of the COI report on the attitude of the international community is yet to be seen, while nuclear issues remain the primary focus of U.S. policy toward North Korea. In his presentation, Yoshihiro Makino will describe the little understood political situation inside North Korea and discuss how the repression of basic rights is fundamental to the regime’s grip on power. Mr. Makino will base his analysis on information gathered through extensive interviews with North Korea specialists, diplomats, and direct sources with first-hand knowledge. He will then offer suggestions on how the US and the international community can use this knowledge to more effectively address human rights issues in North Korea. His presentation will be followed by comments by Bruce Klingner. 4. The Struggle for Democracy in Myanmar/Burma | Tuesday, July 14th | 9:30-11:00 | Brookings Institution | REGISTER TO ATTEND | Myanmar/Burma is in the fourth year of a historic transition out of military rule that began after the junta dissolved itself in March 2011, replaced by an elected parliament and the government led by President Thein Sein. New elections are expected in November for its second government under the 2008 constitution. While expressing commitment to holding a free and fair election, the Thein Sein government has left in place a constitutional obstacle to allowing Aung San Suu Kyi, leader of the opposition National League for Democracy (NLD), from becoming the country’s next president. The NLD seems likely to emerge from the new elections with the most seats in the legislature, but may fall short of its landslide victory in the 1990 election, which was not accepted by the ruling military junta.On July 14, the Center for East Asia Policy Studies at Brookings will host a discussion of Myanmar’s progress over the past four years and the prospects for strengthening democratic rule under the next government. Delphine Schrank, a former reporter with The Washington Post, spent four years among dissidents in Myanmar/Burma and has written a narrative nonfiction account about their epic multi-generational fight for democracy. Her book ‘The Rebel of Rangoon; A Tale of Defiance and Deliverance’ (Nation Books, 2015) will set the stage for the discussion. 7. The Kuwait Crisis 25 Years Later | Wednesday, July 15th | 10:00-11:30 | Brookings Institution | REGISTER TO ATTEND | Twenty five years ago this summer, Iraq provoked a crisis with Kuwait and the United Arab Emirates, demanding debt cancellation and higher oil prices. It proved to be a ruse for a far more daring plan. On August 2, 1990, Iraq invaded and annexed Kuwait. Around the world, people feared that Saddam Hussein’s armies would move on to Saudi Arabia. In response, President George H. W. Bush deployed hundreds of thousands of American troops to the Kingdom, recruited an international alliance to support them, and gained United Nations and U.S. congressional support to liberate Kuwait. The Gulf War fundamentally altered American policy toward the Middle East and laid the foundation for the many successes and failures that followed. Today, Americans continue to wrestle with the legacy of the Gulf War and the dilemma that the Middle East has posed to U.S. foreign policy in the years since. On July 15, the Brookings Intelligence Project will host Brookings Senior Fellows Kenneth Pollack and Bruce Riedel to reflect on the Kuwait crisis a quarter century later, looking back on 1990 and forward from 2015. They will discuss this crucial turning point and its significance for the region and the United States. Riedel, director of the Intelligence Project, will moderate the discussion. Western disengagement has exacerbated some of the more negative regional trends by signaling disinterest and a lack of commitment toward resolving ongoing conflicts and challenges. These current dynamics create several policy challenges for the region and beyond, including whether the festering crises in the Caucasus will feed into broader conflagrations; whether the United States, EU, and Turkey re-evaluate their involvement in the region in light of Russia’s assertive new foreign policy; and whether given other priorities, can the West muster sufficient political will to re-engage, within limits, in high-level regional diplomacy?
On July 15, the Brookings Center on the United States and Europe (CUSE) will host a panel to discuss a new report, Retracing the Caucasian Circle, co-authored by Fiona Hill, Kemal Kirişci, and Andrew Moffatt. In the paper, the authors provide an overview of the geopolitical and security issues facing Armenia, Azerbaijan, and Georgia and their consequences for relations with the West. The report advocates that in spite of major challenges these three actors should not give up on their engagement of the region and should adopt realistic approaches which can be sustained. 10. Civil Resistance and Peacebuilding: How They Connect| Thursday, July 16th | 10:00-11:00 | United States Institute of Peace | REGISTER TO ATTEND | The rise of nonviolent, people power movements around the world has become a defining feature of the 21st century. While some have deteriorated into violent conflict, organized citizen campaigns using nonviolent methods are challenging formidable opponents: unaccountable governance, systemic corruption, institutionalized discrimination, environmental degradation, dictatorship, foreign military occupation, and violent extremism. Their “weapons” are not guns or bombs, but rather protests, boycotts, sit-ins, civil disobedience, building of alternative institutions, and hundreds of other nonviolent means. Combined with the use of traditional political and legal approaches, these movements continue to shape political, social, and economic change across the globe.
This panel will explore how nonviolent civil resistance and peacebuilding reinforce each other. How does civic mobilization fit into the larger peacebuilding agenda? How have nonviolent campaigns and movements contributed to long-term peace and stability? What are the theoretical and practical linkages that might prevent violent conflict and advance a “just peace”? Unfuck Greece
It is difficult to write anything about Greece in the current confused course of events, but I thought this Guardian video captured the situation well:
Unfucking Greece will not be easy. I take it this is the International Monetary Fund report the government is relying on to claim that austerity won’t work. But what the report says is that the debt is unsustainable because of Greek government policy failures.
Later today the Greek Council of State is supposed to rule on the validity of Sunday’s referendum. If it goes ahead, it will be a referendum on staying in the eurozone, though the question posed is not about that but rather about the austerity package the European Union has been pressing.
If I were betting, it would be on a Greek exit from the eurozone, which seems to be the only way to force its creditors into restructuring and reducing its debt. But anyone expecting the good life to return with the drachma is fooling themselves. Devaluation will impoverish Greeks even further.
