Accountability and transparency
Accountability and transparency are today part of America’s international mantra. We want war criminals and human rights abusers in Syria, Iraq and North Korea held accountable. We want open government that allows for public participation and collaboration.
There are two problems with this stance.
Those at the receiving end of our preaching are not necessarily keen on changing their governing system so that things can be done openly and collaboratively. This is obvious for Bashar al Assad, who wouldn’t survive a week in the Syria we would like to create. Kim Jong Un might not survive a day in North Korea.
But it is also true for some of our friends. Egypt’s President Sisi is no more keen on transparency and accountability than Assad, except when it comes to his predecessor and the Muslim Brotherhood. Ditto Prime Minister Netanyahu, who blocks serious efforts to look into the conduct of the latest Gaza war and continues to surprise us with settlement initiatives in Jerusalem and the West Bank. The Burmese government we are now finding amiable has done little for transparency and nothing for accountability of the prior military regime, never mind for its own repression against the Rohingya and others.
The more profound problem is us. Whatever you think about the CIA’s enhanced interrogation techniques or police shootings of unarmed citizens, it is clear we are having a hard time with the idea that anyone should be held accountable if wrong was done, or even with the idea that the proceedings in which such things are decided should be transparent. We decide whether charges should be brought against the police in secret grand jury proceedings. It took years of effort and thousands of excised words to enable the release of the executive summary of the Senate Democrats’ report on a CIA program that clearly made serious errors, even if you believe it also did a lot of good.
Hesitation about accountability and transparency abroad and at home comes from the same source: we and our friends abroad know full well that it will be difficult to get people to do things we might want them to do in the future if we hold them strictly accountable in a transparent way for what their confreres did in the past. President Obama has not made it clear that what many of us regard as torture will never be used again. America’s police don’t want to be told that they have to ask questions first and shoot only when attacked with deadly force. Police unions have actually objected to training intended to teach their members how to de-escalate conflict.
The same is true abroad. Even when dictators are overthrown, their successors may not want strict accountability or even transparency. Iraq’s Prime Minister Maliki did not restore the Saddam Hussein dictatorship, but he was no less keen on security forces that were loyal to him personally. He removed dozens of military and intelligence commanders, replacing them with less professional but intensely loyal officers who proved useless when the Islamic State in Iraq and Syria seized Mosul in June. Brazil has only recently investigated abuses by the military regime that preceded the restoration of democracy there almost thirty years ago. It is not clear that anyone will be held accountable for the abuses.
Most governments treasure stability and order. They need loyal security forces. One of the good reasons for writing strict rules for them is to ensure that they don’t do things we will be hesitant to have see the light of day or hold them accountable for. In the US, it is time for a law prohibiting torture, and a national standard for how to deal with unarmed citizens. If we are going to expect better behavior of others, we need to up our own game.
Ramifications
The United States is to establish diplomatic relations with Cuba. Stronger than expected economic and job growth. American companies repatriating. Russia cancels natural gas pipeline. Pro-Russian separatist push in Ukraine stalls. Iran declares its commitment to reaching a nuclear agreement. Baghdad reaches oil export and revenue agreement with Erbil
Today’s headlines may seem disconnected, but there are two common threads: oil and money, which themselves are tightly wound together.
Little explanation is needed. The Cuban regime is on its last economic legs. It needs an opening to the US to survive. Its massive subsidies from Venezuela are coming to an end, because Caracas is one of the countries most forcefully hit by the decline in oil prices. The economic upturn in the US, and return of US companies from abroad, is at least partly due to more cash in consumers’ pockets, due to lower prices at the pump, and readier availability of energy resources. Russia’s South Stream pipeline fell victim to the combination of sanctions and lower natural gas prices. Russian support for the separatists in eastern Ukraine is falling short in part because the Russian economy is in an oil-price-induced nose dive, along with the ruble. Iran needs a nuclear agreement more than it did a few months ago in order to get sanctions relief that will help it deal with lower oil prices. Both Erbil and Baghdad needed an agreement, not only because of the ISIS threat but also because of lower oil prices, which pinch their finances as much as ISIS’s.
It would be nice to hear some other good news: reduced Russian and Iranian support for Syria’s President Assad, a pickup in China’s economy, and an end to recession in Europe are all within the realm of the possible. May this icy account of an official Iranian visit to Assad is a harbinger.
There is of course a price to pay for the benefits of lower energy prices. US oil and gas production, which had been climbing rapidly at $100/barrel, will slow down at $50/barrel. Oil company stocks are down. The stock market is jittery. Kim Jong Un, his economic woes relieved, is emboldened and less vulnerable.
The balance for America’s foreign policy is however positive. It is also likely to be long-lasting. American oil and gas production may stop climbing so fast, or even fall, laying the foundation for another price rise in the future. But the new technologies that enable exploitation of “tight” oil and gas are viable at anything above $80/barrel, and likely at prices a bit lower. Nor is the US the only country in which these technologies can be used. China, the UK, Poland and many others also have “tight” oil and gas. Once they start producing it, $80/barrel or so will become a ceiling for oil prices, a level that will require serious fiscal discipline in many oil-producing countries, both friend and foe. Russia, Venezuela and Iran have all been budgeting at $100/barrel or more.
The demand side also has an impact on foreign policy. While supply has been booming in the Western Hemisphere, demand is booming in the East, especially China and India. Middle Eastern oil that used to get shipped to Europe and the US will now go to Asia. That is already true for 50% of the oil coming through the strait of Hormuz. The percentage is headed up to 90% within the next decade. US diplomats are busily reassuring Gulf oil producers that Washington is fully committed to maintaining its close relations with them, but it is hard to believe we are that dumb (or that they are).
Rapidly declining oil imports from the Gulf will eventually make the Americans reevaluate. If and when the Iranian nuclear issue is resolved, Washington will want to renew the effort to move its diplomatic and military attention even more definitively to the East, where its economic and commercial focus already lies. China and India will have to pick up more of the burden for energy security, by holding larger oil stocks (neither keeps the 90 days that International Energy Agency members commit to) and naval patrolling. The US should be welcoming them with open arms into a multilateral effort to protect Hormuz. A few extra burdens of this sort would also encourage New Delhi and Beijing to restrain their oil demand and contribute more to limiting global warming.
The ramifications of lower oil prices are profound. We would do well to start thinking hard about them and acting accordingly.
The troubles we see
This year’s Council on Foreign Relations Preventive Priorities Survey was published this morning. It annually surveys the globe for a total of 30 Tier 1, 2 and 3 priorities for the United States. Tier 1s have a high or moderate impact on US interests or a high or moderate likelihood (above 50-50). Tier 2s can have low likelihood but high impact on US interests, moderate (50-50) likelihood and moderate impact on US interests, or high likelihood and low impact on US interests. Tier 3s are all the rest. Data is crowdsourced from a gaggle of experts, including me.
We aren’t going to be telling you anything you don’t know this year, but the exercise is still instructive. The two new Tier 1 contingencies are Russian intervention in Ukraine and heightened tensions in Israel/Palestine. A new Tier 2 priority is Kurdish violence within Turkey. I don’t believe I voted for that one. Ebola made it only to Tier 3, as did political unrest in China and possible succession problems in Thailand. I had Ebola higher than that.
Not surprisingly, the top slot (high likelihood and high impact) goes to ISIS. Military confrontation in the South China Sea moved up to Tier 1. Internal instability in Pakistan moved down, as did political instability in Jordan. Six issues fell off the list: conflict in Somalia, a China/India clash, Mali, Democratic Republic of the Congo Bangladesh and conflict between Sudan and South Sudan.
Remaining in Tier 1 are a mass casualty attack on the US homeland (hard to remove that one), a serious cyberattack (that’s likely to be perennial too), a North Korea crisis, and an Israeli attack on Iran. Syria and Afghanistan remain in Tier 2 (I think I had Syria higher than that).
The Greater Middle East looms large in this list. Tier 2 is all Greater Middle East, including Libya, Egypt, Jordan, Lebanon, Pakistan, Turkey and Yemen (in addition to Tier 1 priorities Israel/Iran, Syria, Afghanistan and Palestine). That makes 11 out of 30, all in the top two tiers. Saudi monarchy succession is not even mentioned. Nor is Bahrain.
Sub-Saharan Africa makes it only into Tier 3. Latin America and much of Southeast Asia escape mention.
There is a question in my mind whether the exclusively country-by-country approach of this survey makes sense. It is true of course that problems in the Middle East vary from country to country, but there are also some common threads: Islamic extremism, weak and fragile states, exclusionary governance, demographic challenges and economic failure. From a policy response perspective, it may make more sense to focus on those than to try to define “contingencies” country by country. If you really wanted to prevent some of these things from happening, you would surely have to broaden the focus beyond national borders. Russian expansionism into Russian-speaking territories on its periphery might be another more thematic way of defining contingencies.
One of the key factors in foreign policy is entirely missing from this list: domestic American politics and the difficulties it creates for a concerted posture in international affairs. Just to offer a couple of examples: failure to continue to pay Afghanistan’s security sector bills, Congressional passage of new Iran sanctions before the P5+1 negotiations are completed, or a decision by President Obama to abandon entirely support for the Syrian opposition. The survey ignores American “agency” in determining whether contingencies happen, or not. That isn’t the world I live in.
For my Balkans readers: no, you are not on the list, and you haven’t been for a long time so far as I can tell. In fact, it is hard to picture how any contingency today in the Balkans could make it even to Tier 3. That’s the good news. But it also means you should not be looking to Washington for solutions to your problems. Brussels and your own capitals are the places to start.
Why coming clean is important
The Middle East Institute published this piece last night under the heading Iran’s Nuclear Secrets Need to be Revealed. It puts me in agreement with hawkish views. But I think there is no escaping the need for Iran to come clean, at least to the IAEA.
Expert American opinion on the outcome of last month’s nuclear negotiations with Iran is sharply divided. Those who want Iran to give up all enrichment technology are relieved that a “bad” deal was averted. Pressure is building in Congress, especially but not exclusively among Republicans, for new sanctions.[1] Some would like to see Congress authorize the use of military force.[2] Others think an interim arrangement limiting Iranian enrichment (the November 2013 “Joint Plan of Action,”[3] which took effect January 20, 2014) is good enough for now and certainly better than no limits.[4] They resist the idea of new sanctions and hope for an agreement by the new July 2015 deadline that will provide as much as a year’s warning of any Iranian moves to produce the material needed for a nuclear weapon.[5]
Both perspectives focus on the overt Iranian nuclear program, which is monitored and safeguarded by the International Atomic Energy Agency (IAEA) under provisions of the Nonproliferation Treaty (NPT). But no country since the IAEA was founded in 1957 has used an overt program or safeguarded material to obtain nuclear weapons. Nuclear powers India, Pakistan, and Israel never signed the NPT. North Korea signed but withdrew before testing a nuclear weapon, using material produced clandestinely. South Africa developed and tested nuclear weapons clandestinely before it became an NPT signatory in 1991, when it gave them up. Belarus, Ukraine, and Kazakhstan had many Soviet nuclear weapons on their territory but transferred them out and joined the NPT in the 1990s, after the Soviet Union collapsed.
It is hard to avoid the conclusion that clandestine and non-safeguarded nuclear programs are a much greater risk for proliferation than the ones the IAEA monitors.
Iran is an NPT signatory. Its safeguarded facilities are in compliance with its NPT obligations. It is also in compliance with the Joint Plan of Action. But Iran has not implemented all resolutions of the IAEA Board of Governors or the UN Security Council, nor has it implemented the Additional Protocol that permits short-notice inspections of suspect locations. The IAEA’s bottom line is ominous:
The Agency is not in a position to provide credible assurance about the absence of undeclared nuclear material and activities in Iran, and therefore to conclude that all nuclear material in Iran is in peaceful activities.[6]
The question of covert facilities is said to preoccupy some American negotiators, but the negotiations have focused on Iran’s overt, safeguarded program.[7]
The clandestine route to a nuclear weapon is far more likely. The IAEA has asked Tehran to explain research efforts that IAEA scientists associate with nuclear weapons research, including initiation of high explosives (to compress fissionable material) and neutron transport calculations (required to initiate a chain reaction).[8] Tehran has not yet provided a satisfactory response to these inquiries or access to facilities where unsafeguarded activities may have taken place in the past. American intelligence agencies have said publicly that they believe this weapons-related research ended more than a decade ago.[9] But earlier efforts that betrayed “possible military dimensions” remain a source of profound distrust of Iranian intentions, not only in the United States but also in Israel and elsewhere.
Iranians are quick to respond that the Supreme Leader has issued a fatwa against production or use of nuclear weapons. This can be “secularized,” meaning it can be issued as legislation.[10] They also emphasize that Iran would be far less secure if it obtained nuclear weapons but in the process triggered Saudi, Egyptian, or other efforts to match the prize. Far better, some say in private, to gain the underlying technology but stop short of weaponizing, which is an expensive process of not only producing the weapons but also making them compact enough to be mounted on missiles and launched. [11]
Americans concerned about an Iranian clandestine nuclear program want Tehran to “come clean” about its past activities.[12] This is what Muammar Qaddafi did in 2003, when he opened up Libya’s clandestine (but still rudimentary) nuclear program to intense American scrutiny and removal. It is difficult to picture Iran doing as much as that. But it could, and should, go much further than it has so far in answering frankly the IAEA’s pointed questions about its past weapons-related research and development.
The United States can hope that the current negotiations on Iran’s overt nuclear program will put a year between any decision to get nuclear weapons and the result, in exchange for some measure of sanctions relief. It has to aim to do at least that well on the clandestine side as well. This will mean not only Iranian implementation of the Additional Protocol that allows surprise inspections, but also a clear and comprehensive account of past weapons-related nuclear research and development.

- Iranian Policy toward the Iraqi and Syrian Crises | Tuesday, October 21st | 12:00 – 1:00 | Woodrow Wilson International Center for Scholars | Jubin Goodarzi, Deputy Head of the International Relations Department at Webster University in Geneva, Switzerland will speak at the event. Tehran has had a longstanding alliance with Damascus over the past 35 years, and its relations with Baghdad have steadily improved since the ouster of Saddam Hussein in 2003. This has resulted in close ties between Iran and these two key Arab states. However, this has all been called into question since the eruption of the Syrian revolt in 2011, and moreover, the recent rise of ISIS and its challenge to the Iraqi state. Iran has become heavily involved in both conflicts since it has much at stake. Jubin Goodarzi will provide an overview of the evolving situation and focus on Iran’s policies, perspectives, interests, and options in the ongoing Syrian and Iraqi crises.
- A Fresh Perspective on Tunisia | Wednesday, October 22nd | 10:00 – 11:30 | Johns Hopkins School of Advanced International Studies | REGISTER TO ATTEND | Mondher Zenaidi, Independent Presidential candidate for the Republic of Tunisia, will discuss this topic. During the 2011 revolution, Zenaidi was the only member of the government to support the young demonstrators in Kasserine with his presence, including attending the funeral of civilians killed in the city of Ezzouhour, and had the police in the region replaced by the national army to restore the peace. While serving in the Tunisian government, he chaired a committee at the World Trade Organization. He supports broad trade reform to enable Tunisia to adhere to WTO principles and exploit its comparative advantages. He advocates for reduced state involvement in the economy to revitalize Tunisia and reduce disparities in regional development. Zenaidi is also a vocal advocate for a closer U.S.-Tunisian partnership, especially to counter violent extremism and terrorism.

- Reflections on Islamism: From the Muslim Brotherhood to the Islamic State | Thursday, October 23rd | 12:30 – 2:00 | Washington Institute for Near East Policy | REGISTER TO ATTEND | Once again, Islamism has taken center stage in the Middle East. A generation ago, the pivotal events were the takeover of the Mecca mosque and the Islamic Revolution in Iran; a half-generation ago, the pivotal events were the horrific attacks of September 11. With the counterrevolution against the world’s oldest Islamist movement, the Muslim Brotherhood in Egypt, and the sudden and bloody emergence of its newest, the “caliphate” called the Islamic State, the complex face of Islamism is again capturing the attention of governments, journalists, analysts, and popular imagination. To inform our understanding of the changing face of Islamism and provide a scholarly context for the decisions policymakers need to make. The speaker is Shimon Shamir, the dean of Middle East scholars in Israel, is professor emeritus of Middle East history at Tel Aviv University. In addition, he had the unique experience of serving as Israel’s ambassador to both Arab states with which it is at peace, Egypt and Jordan.

REGISTER TO ATTEND In the wake of the recent four-month extension of negotiations for a comprehensive deal on Iran’s nuclear program, JINSA’s Gemunder Center for Defense and Strategy will hold a lunch panel event to assess this outcome and discuss steps going forward for U.S. policy to prevent a nuclear Iran. REGISTER TO ATTEND In June, the government of Colombia and the FARC parties issued a ground-breaking declaration of principles on victims. They announced that they were inviting a delegation of victims to participate in the talks, and that other opportunities will be created for victims to be heard within the peace process. They requested that the United Nations and the National University convene a series of three regional and one national forum for victims to present their proposals. Two forums have already taken place and the others are scheduled for late July and early August. This event will discuss victims’ rights and proposals from four victims of different groups, including guerrillas, paramilitaries, and the State. A half a century of internal armed conflict has resulted in more than 6.5 million victims officially registered with the Colombian government’s Victims’ Unit. This is an opportunity to hear diverse perspectives of leaders who are survivors of violence to discuss their proposals for a just and lasting peace.
